Terms and conditions

Version 1.0 · Last updated 22 October 2026

This document is also available in Danish. The English version is legally binding.

1. About these terms

  1. 1.1

    These terms and conditions apply to all agreements on website design, development, migration, hosting and related services delivered by Acurcio (ACurcio Webservices), CVR 46182162, Jægersborggade 44, 1. th, 2200 København N, Denmark ("we", "us").

  2. 1.2

    Our services are offered to businesses and freelancers. These terms are written for business-to-business agreements and do not apply to consumers.

  3. 1.3

    Anything agreed in writing in a quote or an agreement takes precedence over these terms.

  4. 1.4

    These terms are available in English and Danish. The English version is legally binding; the Danish version is a translation provided for convenience.

2. Quotes and agreements

  1. 2.1

    A quote is valid for 30 days unless it states otherwise.

  2. 2.2

    The agreement is entered into when you accept our quote or sign the agreement in writing, including by email. The date of acceptance is stated in the agreement and is referred to as the "Agreement Date".

  3. 2.3

    The quote describes the scope of the work. Work outside that scope is only carried out by agreement and is invoiced at our hourly rate or according to a separate quote.

3. Prices and payment

  1. 3.1

    All prices are in Danish kroner (DKK) excluding VAT. Our current hourly rate is stated on our website.

  2. 3.2

    Unless the quote states otherwise, the project price is invoiced in full on the Agreement Date and is paid before work begins. Hourly work is invoiced monthly in arrears.

  3. 3.3

    AI features, such as the AI support chatbot, run with Scaleway in the EU and are invoiced monthly in arrears based on usage, at the usage price stated in the quote or in our current price list.

  4. 3.4

    The payment term is 8 days net. On late payment, we may charge interest and reminder fees in accordance with the Danish Interest Act (renteloven).

  5. 3.5

    If an invoice is more than 30 days overdue and remains unpaid after a written reminder, we may postpone delivery or suspend hosting or AI features until it has been paid.

4. Delivery and cooperation

  1. 4.1

    We deliver the work described in the quote within the agreed timeline.

  2. 4.2

    You provide content, access, information and feedback within reasonable time. Delays on your side may move the timeline.

  3. 4.3

    You are responsible for holding the rights to texts, images, logos and other material you provide, and for the content published on your website being lawful.

  4. 4.4

    The website counts as delivered when it is launched or when you approve it, whichever comes first.

5. Ownership and rights

  1. 5.1

    When the agreed price has been paid in full, you own the design, code and content created specifically for your website, and you may use, change and move it freely.

  2. 5.2

    General tools, components and know-how that we use across projects remain ours; you receive a permanent, free right to use them as part of your website. Open-source software is covered by its own licences.

  3. 5.3

    We may show the finished website in our portfolio unless you ask us not to.

6. Free hosting

  1. 6.1

    Free hosting is included with all website packages (Starter, Professional and Custom). You may instead choose to have your website hosted in your own account, see 6.8.

  2. 6.2

    We guarantee free hosting for at least three (3) years from the Agreement Date.

  3. 6.3

    Free hosting includes:

    • hosting of your website on our account with a professional hosting provider (currently Vercel);
    • SSL certificate (https) and global content delivery (CDN);
    • publishing the updates we make to your website.
  4. 6.4

    Free hosting does not include:

    • domain registration and renewal, which is registered in your name and paid by you;
    • email accounts and email hosting;
    • AI features such as the AI support chatbot, which are invoiced monthly based on usage (see 3.3);
    • third-party services with their own fees or usage-based costs, such as booking systems, paid plugins or external databases;
    • changes, new features and other work on the website, which are invoiced at our hourly rate or by quote.
  5. 6.5

    Fair use. Free hosting covers the normal traffic and use of a website for a business or freelancer. If your website’s use goes clearly beyond that — for example very high traffic, large file downloads or heavy server processing — we will contact you and agree on a solution, such as paid hosting or moving the website to your own account. We never invoice extra hosting costs without your prior agreement.

  6. 6.6

    Availability. We use a professional hosting provider and work to keep your website online, but we do not guarantee uptime beyond what the provider offers, and we are not liable for outages at the provider.

  7. 6.7

    We may move your website to another hosting provider of equivalent quality, at no cost to you.

  8. 6.8

    Your own account. At any time — on the Agreement Date or later — you can ask us to move your website to your own accounts with a hosting provider of your choice. Up to two (2) hours of work on the move is free of charge. Any work beyond that is invoiced at our hourly rate, and we give you an estimate before we start. Free hosting ends when the move is completed, and you pay the hosting costs in your own account.

  9. 6.9

    After the guaranteed period, hosting continues on the same terms until we give notice. We give at least three (3) months’ written notice before free hosting ends. You then choose to either:

    • have the website moved to your own account as described in 6.8; or
    • continue with paid hosting through us, at the price stated in the notice.
  10. 6.10

    If you have not chosen by the end of the notice period, we may take the website offline. We keep a copy of its code and content for at least six (6) months afterwards and hand it over on request.

  11. 6.11

    If we close our business, we move your website to your own accounts free of charge before hosting ends.

  12. 6.12

    We may temporarily suspend the website if it contains unlawful content, is misused, or poses a security risk to you, us or others. We will inform you as soon as possible.

7. Data protection

  1. 7.1

    When we host a website that processes personal data — for example through a contact form — we process that data on your behalf as data processor, and you are the data controller.

  2. 7.2

    Our data processing agreement, published at www.acurcio.dk/en/data-processing-agreement, forms part of the agreement and is accepted together with it. It lists our sub-processors, including the hosting provider.

  3. 7.3

    You are responsible for your website’s privacy policy and for having a lawful basis for collecting personal data.

8. Errors and remedies

  1. 8.1

    For three (3) months after delivery, we fix errors in our work free of charge, up to a total of three (3) hours of work. Error fixing beyond that is invoiced at our hourly rate.

  2. 8.2

    Errors caused by changes made by you or third parties, or by changes to third-party services, are fixed at our hourly rate.

9. Liability

  1. 9.1

    Our total liability under the agreement is limited to the amount you have paid us under the agreement in the 12 months before the claim arose.

  2. 9.2

    We are not liable for indirect loss, including lost revenue, lost profit, lost data or loss of goodwill.

  3. 9.3

    We are not liable for third-party services, including the hosting provider, the domain registrar and other services the website depends on.

  4. 9.4

    These limitations do not apply if the loss is caused by gross negligence or intent.

10. Cancellation and termination

  1. 10.1

    You may cancel a project before delivery. You then pay for the work carried out up to the cancellation at our hourly rate, but never more than the agreed project price.

  2. 10.2

    Either party may terminate the agreement with immediate effect if the other party materially breaches it and does not remedy the breach within 14 days of written notice.

11. Changes to these terms

  1. 11.1

    We may update these terms. The version in force on the Agreement Date applies to your agreement, and later changes never reduce the free hosting guarantee in section 6 without your written consent.

12. Governing law and disputes

  1. 12.1

    These terms and the agreement are governed by Danish law.

  2. 12.2

    We will always try to resolve a disagreement through dialogue first. Disputes that cannot be resolved are settled by the Copenhagen City Court (Københavns Byret) as the court of first instance.
